1) All online bidders must submit an application for bidding approval and receive a permanent bidder number from Texas Star Auctions before actual bidding can begin. Texas Star Auctions will return by email the bidder number within 24 hours of receipt of the application. This bidder number and your driver's license number will allow you to bid on any item and give you access to your user page where current bids are shown, past invoices, links for items, alerts, updating your data file and becoming a seller on Texas Star Auctions web site. Bidders wishing to use resale certificates must email or fax the information to molly@txstarauctions.com or jayson@txstarauctions.com or 936-570-1321 before taxes will not be charged to you. Farm Use buyers please contact Texas Star Auctions for proper procedure.
2) All items are sold as is, where is! Loading assistance is NOT usually available unless otherwise stated, with no warranty or guarantee implied or intended by the seller or Texas Star Auctions. All sales are final and the bidder is responsible for knowing which item he is bidding on. We recommend each bidder make every effort to confirm item descriptions to their satisfaction by visual inspection or by making contact with the seller for confirmation before bidding on any item. Once the item is declared sold, it becomes the responsibility of the buyer with all liabilities attached thereto. Should the item turn up missing at pickup time, please contact the local police authorities and report them as stolen, no refunds will be made by Texas Star Auctions or the seller.
3) All bids will require a maximum bid amount and our program will automatically increase your bid whenever another bid is placed on the item above your current high up to you maximum amount. You may increase your maximum bid at any time and the amount of your current bid will not be increased! Each bid will be increased by an established increment set by Texas Star Auctions on each item. All bidding for the online auction items ends at 1 PM on the closing day listed for the item.
a) Items with quantities greater than one will be sold by each; with the bidder choosing the number he wants times the high bid amount. As bids are received each bidder will show up as currently successful for the quantity wanted as long as his max bid is equal to or greater than the current bid until all are spoken for. All bidders will then increase by the bid increment as bidding continues with the lowest max bid being eliminated when a bid max is placed higher than theirs. If the quantity bid on is less than the total available, then a bid placed equal to the current bid could get you the available units. Changing maximum or quantity could cause bidding against you depending on other bidder’s bids.
4) Acceptable payment is by Visa, MasterCard, and Discover credit cards. Personal and company checks will be accepted ONLY with an attached bank letter of guarantee of payment or Texas Star Auctions prior approval. Online auctions will be invoiced within 4 hours of the closing time with payment being applied to the credit card on file unless prior arrangements are made. All winning bids at online auctions will be notified by email with an invoice showing items purchased, taxes collected, total amount charged to the credit card or record within 24 hours of the completion of the sale. A 5% BUYERS PREMIUM will be added to each purchase, unless otherwise noted. All purchases are due and payable in US funds at Lufkin, Angelina County, Texas, USA.
A contact will be included in all emailed invoices for scheduling pickup within the 5 business days allotted. Buyers MUST present an invoice as proof of purchase when picking up their purchases from the seller!
5) All items must be removed by noon on the fifth business day after the sale, unless other arrangements are made with the seller during this time frame. Items not picked up will be considered abandoned and properly disposed of by the seller with no refunds!
6) Vehicle title papers will be issued by the seller within 10 working days of the sale to the buyer as registered, unless otherwise notified within 24 hours of notice of award. Odometer readings are not guaranteed to be actual unless so indicated. Gun buyers must be 21 years of age, a resident of Texas and we must have your social security number, ATF dealer number or concealed carry number on file before transfer of the firearm.
7) The items described in this listing are assumed to be true and correct to the best ability of the owner and Texas Star Auctions. Any oral statements made during this auction will take precedence over all written notices or advertisements issued prior to the sale.
8) Anyone who fails to complete a transaction associated with any bids placed with Texas Star Auctions, will be removed from the bidder list. Bidders failing to complete transactions in excess of $1000.00 will be sued for breach of contract! Any legal action arising from transactions related to an online auction conducted by Texas Star Auctions will be conducted in Angelina County, Texas, USA and under the current laws of the State of Texas, USA. All operations of this web page are based in Texas and operated under the current laws of Texas, regardless of user or operator computer location.
Seller Terms & Conditions
Texas Star Auctions accepts consignments of items to be sold at auction through our web page, www.texasstarauctions.com, from any source of legitimate merchandise sold absolute to the highest bidder. We charge a flat fee of 10% of the selling price and make payment to seller at the end of each month for any and all items sold during that month. If your item does not sell, then you are not charged a 10% seller fee and there are no listing fee's. So, you could list your item 100 times and it not cost you a dime! Texas Star Auctions collects all Texas sales tax due and remits them to the state.
To be a seller with Texas Star Auctions you first must be a registered online bidder. After you have received a bidder number, click on the Become A Seller link from your User Profile page and agree to the Seller Terms & Conditions. This sets you up to submit items for auction through our online auction section. In the menu box on your User Profile there is now a link to submit items which brings up a simple form to fill out and attach up to four pictures showing all angles to provide bidders a complete view of the item. Be sure your camera is set to produce the smallest file size possible. We need a full and trust worthy description of the make, year, model and anything else that will provide truthful information to bidders. We need a contact person's name, phone number and email for bidders to contact for additional information or to make an appointment to view and we need to know the location of each item. Any titled vehicle will not be listed until a copy of the title, front & back, is faxed to Texas Star Auctions at 936-570-1321 as proof of title, or an emailed copy of the title is received @ molly@txstarauctions.com or jayson@txstarauctions.com . For Farm trailers without titles we need a photo of the last license plate receipt, which will show if there is a title issued and or VIN on the unit, in which case we will need a photo of the title emailed promptly.
Upon verification of the item to be sold, we will post the item for a minimum of seven days with the closing time as 1PM on the final date. We will email a copy of the buyer's invoice to the seller for his/her records. The buyer has five business days to pick up, make arrangements to pick up, or have their items delivered from the seller. Any shipping of items by the seller will be at the buyer expense or as agreed to between seller and buyer.

When you agree to these terms and submit the above needed items and pictures, you acknowledge these terms for selling through Texas Star Auctions web site. You are legally bound to fulfill all the terms including delivery to the buyer the item listed and shown in the quality and condition as was shown on the bidding page at Texas Star Auctions' web site during the same time frame of 5 business days from the buyer’s invoice.

THIS AUCTION SITE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, OR RESULTING FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO, OR ALTERATION OF MEMBER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF THIS AUCTION SITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Can I sell here?
Anyone who is legally allowed to own an item is allowed to buy or sell it here. The following information is not intended to be a complete guide to all applicable laws. It is your responsibility to be in compliance with all Federal, state, and local laws when using this site.
What does legally allowed mean? You must be an adult who is able to enter into a contract. Anyone desiring to purchase a firearm must be able to pass a background check ( Click here for the ATF web site for more information ). There are age limits on the sale of certain items. And certain types of items are illegal in certain places - for example 'assault weapons' cannot be sold in California and certain types of ammunition are illegal in certain states and cities. The NRA also has put together a terrific state-by-state gun laws guide. The ATF has compiled information on the various state laws; click here to view this information. Again, it is your responsibility to make sure that you comply with the laws of your country, city, and state. We do not tolerate attempted illegal activity here!
You do not have to be a licensed dealer to sell a firearm. By Federal law, the person to whom you ship the gun must be a licensed dealer. If the buyer is not a licensed dealer, the buyer must make arrangements with a licensed dealer in his state to receive the firearm and transfer it to the buyer.
